Official Rules and Regulations

  1. ELIGIBILITY: This "Jump to South Africa - 2010" program (the "Program") is conducted by Canadian Tire Jumpstart (the "Sponsor" or "Canadian Tire Jumpstart"), and is open to all residents of Canada.
  2. PARTICIPATION: No purchase is necessary. Complete the official registration process and set up your personal fundraising page at www.jumptosouthafrica.ca. Garner online donations from individuals to raise funds for Canadian Tire Jumpstart to earn rewards. The Program begins at 12:00:01AM (EST) on March 1, 2010, and ends at 11:59:59PM on April 18, 2010. Limit one fundraising page per person/email address.
  3. AGREEMENT OF OFFICAL RULES: By participating in the Program, entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Program. Receiving rewards is contingent upon fulfilling all requirements set forth herein.
  4. REWARDS: Fundraisers will be rewarded with the items listed below should the funds raised meet the outlined criteria:
    1. For every $100 CDN raised, fundraisers receive 10 music downloads, up to a maximum of 50 songs (retail value: $1 per song)
    2. Those fundraisers who raise $501 CDN - $1000 CDN will receive an iPod Shuffle (approximate retail value: $62 CDN)
    3. Those fundraisers who raise $1,000+ CDN will receive a Nintendo DS (approximate retail value: $139 CDN)
    4. The third place fundraiser will receive a Bose Sound Dock (approximate retail value: $279 CDN)
    5. The second place fundraiser will receive a Sony VAIO 10.1" Intel Atom N280 1.66GHz Netbook (approximate retail value: $459 CDN)
    6. The first place fundraiser will receive the Jump to South Africa reward package:
      A trip package for 2 children between the ages of 13 – 16 to the Coca-Cola 2010 International Football Camp including coach-class air transportation from an airport near winner's home (determined by Sponsor in its sole discretion) to Johannesburg, South Africa; 6 days and 5 nights accommodations at the High Performance Centre in Pretoria, South Africa; ground transportation for length of stay; security for length of stay; meals and beverages for length of stay (as determined by Sponsor in its sole discretion); a training kit (contents determined by Sponsor in its sole discretion); an African Safari experience (details determined by Sponsor in its sole discretion); tickets to a 2010 FIFA World Cup match (Cat.2/Cat.3 game, seating determined by Sponsor in its sole discretion); and opportunity to participate in the Legacy program with local underprivileged kids (details determined by Sponsor in its sole discretion). Those attending the International Soccer Camp must be between the ages of 13 and 16 as of June 1, 2010 and will be accompanied by 2 chaperones determined by Sponsor in its sole discretion. Winner must travel on June 15, 2010 and return on June 20, 2010 or winner forfeits reward. Sponsor will determine airline, flight itinerary, hotels and any events and/or activities. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in these Official Rules, and those set forth by the Sponsor's airline carrier of choice as detailed in the passenger ticket contract. All expenses, travel, and other costs not expressly stated in the package description above are the sole responsibility of winner. Individuals taking the trip are solely responsible for obtaining any required medical vaccinations and obtaining a valid passport, with a minimum of 2 blank pages, and any other documents necessary for international travel. These pages are in addition to the endorsement/amendment pages (as many as 4) at the back of the passport. Restrictions, conditions and limitations may apply. The parent/legal guardian of winner's guest must execute liability/publicity releases prior to issuance of travel documents. Lost, mutilated, or stolen tickets, vouchers or certificates will not be replaced. By accepting ticket reward, winner agrees to abide by any terms, conditions and restrictions provided by the ticket. Sponsor not responsible if winner does not use a ticket on the day of an event. Approximate Retail Value (“ARV”): $11,200 CDN based on Toronto departure. The ARV of travel may vary based on airfare fluctuations and distance between departure and destination. Winner will not receive difference between actual and approximate retail value. No substitution, exchange or transfer of reward by winner, unless winner does not meet the age requirements to attend the International Soccer Camp, in which case, the winner is permitted to transfer the reward to the parent/legal guardian of a child residing in Canada between the ages of 13 and 16 who can attend the International Soccer Camp. No cash equivalent. Winners are responsible for costs, taxes and fees associated with reward receipt and/or use not specifically indicated in these Official Rules. Odds of winning a Program reward depend on the number of eligible entries received during the Promotion Period. Limit: of one (1) reward per person.
  5. TIE: In the event of a tie for the first, second or third place fundraisers:
    1. The fundraiser to first reach the highest fundraising amount in CDN dollars will receive the official reward as outlined in section 4f. Any additional fundraisers who raise the same amount of funds will be rewarded with an item as deemed appropriate by the Sponsor.
    2. Should there be a tie for the second and third place rewards, each individual who falls within these categories will receive the reward as outlined in sections 4d and 4e.
  6. PUBLICITY: Except where prohibited by law, the fundraisers' participation in the Program constitutes as consent of each such fundraiser's parent or legal guardian for Sponsor to use his/her name, likeness, photograph, voice, opinions, biographical information, and address for promotional purposes in any and all forms of media, now known or hereafter devised including without limitation the Internet (unless prohibited by law) worldwide, in perpetuity, without further payment or consideration.
  7. GENERAL CONDITIONS: Sponsor reserves the right to suspend, cancel or modify the Program without notice for any reason including but not limited to, the discovery of an error of any kind in the Official Rules, fraud, technical failures or any other factor beyond the Sponsor's reasonable control that impairs the integrity of the Program, as determined by the Sponsor in its sole discretion. In such event, the Sponsor reserves the right to award the rewards at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Program or to be acting in violation of these Official Rules or any other program, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Program is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  8. RELEASE: By participating in the Program, entrant agrees (or their parent / guardian where applicable) to release and hold harmless Canadian Tire Jumpstart, Canadian Tire Corporation, Limited ("CTC"), and any Program partners, each of their parent, subsidiary, affiliate and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the "Released Parties") from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Program, or resulting directly of indirectly, from acceptance, possession, use, or misuse of the rewards awarded in connection with the Program, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
  9. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information associated with or utilized in the Program; (2) technical failures of any kind, including, but not limited to malfunctions, slow down, interruptions, or disconnections in phone networks or lines or network hardware or software connected to or related to the Program; any problems or technical malfunction or speed or quality of any telephone network or lines, computer online systems, servers, access providers, computer equipment, or software howsoever caused; failure of any email or transmission to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website; any injury or damage to a registrant or any other person or their computer or other property, related to or resulting from participating in this Program or website offers, or downloading any material related thereto; or, any combination thereof; (3) unauthorized human intervention in any part of the entry process or the Program; (4) technical or human error which may occur or arise or may have occurred in the Official Rules, in the administration of the Program or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Program or receipt or use of any reward or while traveling to or from any reward-related activity. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Program; provided that the Program has not been completed. In the event that it is not possible to award another entry due to discontinuance of the Program for any reason, the Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for the reward. No more than the stated number of rewards will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of rewards to be available and/or claimed, the Sponsor reserves the right to award only the stated number of rewards. The Released Parties are not responsible for any online or other charges entrants may incur in connection with participating in the Program.
    The Released Parties are not responsible for the availability or content of any other website to which the Jump to South Africa website is linked. All content on the website is the property of Canadian Tire Jumpstart.
  10. DISPUTES: Entrant agrees that under no circumstances will entrants be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages , and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the laws of Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
  11. PRIVACY: The Sponsor will use entrants' contact information provided in the Program entries for the administration, advertising and promotion of this Program in accordance with the Sponsor's privacy policies found on the Canadian Tire website.
